BUSTANOBY CASE DISMISSED

Woman Fails To Appear Against Policeman In Assault Charge

Mrs. Doris Bustanoby, wife of the former restaurateur, did not appear in the Washington Heights court yesterday to press an assault charge against patrolman John Hart of the Traffic Court, and the case was dismissed. A young man, who said he represented Mrs. Bustanoby, delivered a letter to Magistrate James M. Barret written by Mrs.
Bustanoby at Milford, Pennslyvania in which she said she was forced to go to Milford because of ill health and did not know when she would be able to return to the city. Dismissing the charges the magistrate remarked that the case could be reopened through a presentation of the facts to District Attorney Banton. Mrs. Bustanoby had caused the arrest of the patrolman in the West 30th Street Station on October 11 last when she had identified him as the policeman who, the night before, had attacked her, so she charged, in her automobile at Convent Avenue and 129th Street next door to where the patrolman lives. She said that her car had become stalled and that the policeman had attacked her after volunteering to start it for her.
